TERMS OF SERVICE AND CLIENT AGREEMENT
Effective Date: November 12, 2025
1. Acceptance of Terms
By enrolling in or using services provided by Level Up Results or RESULTS by Twyla, you agree to these Terms of Service ("TOS") and acknowledge that you have read, understood, and accepted the terms outlined herein. These TOS apply to both virtual and in-person coaching, fitness, wellness, and nutritional programs.
2. Services Provided
Our services include, but are not limited to:

Virtual and in-person fitness coaching and exercise instruction

Core strengthening and movement guidance
-
Nutritional coaching and guidance
-
Wellness and lifestyle coaching
-
Educational content related to fitness, nutrition, and health
-
Self-care techniques, including self-massage and bodywork instruction for educational purposes only
Services DO NOT include:

Professional massage therapy or bodywork
-
Manual therapy performed by a licensed practitioner
-
Medical diagnosis or treatment
3. Client Responsibilities
Clients are responsible for:

Providing accurate and complete health, fitness, and nutrition information
-
Following instructions safely and responsibly
-
Ensuring a safe environment for virtual sessions
-
Listening to their body and discontinuing any activity causing pain or discomfort
-
Seeking guidance from licensed professionals for medical or dietary concerns outside the scope of these services
4. Payment and Billing
-
Payment is required before access to services unless a separate arrangement is agreed upon.

Monthly programs may be canceled at any time through the client portal, effective at the end of the current billing cycle.

No refunds are provided for past services, partial months, or missed sessions unless otherwise stated.

One-time courtesy options such as pausing memberships for up to 6 months or transferring credits may be available at management discretion.
5. Cancellation Policy

In-person or virtual individual sessions require a 24-hour notice for cancellations.

Sessions canceled with less than 24 hours’ notice may forfeit payment, unless approved as an emergency at management discretion.

Emergency cancellations will be considered for credit on a case-by-case basis.
6. Media and Promotional Use

By participating, you consent that photos, videos, or testimonials taken during sessions may be used for promotional or educational purposes.

You may opt out of promotional use at any time without affecting access to services.
7. Privacy and Data
-
Use of services is subject to our Privacy Policy, which explains how your information is collected, used, and stored.

Clients agree to the collection, storage, and use of data as described in the Privacy Policy.
8. Health and Medical Disclaimer
-
Services are educational and for wellness purposes only.
-
Clients should consult with licensed healthcare providers before starting any program.
-
Participation in nutrition or fitness guidance is voluntary and at the client’s own risk.
9. Limitation of Liability
-
Clients release Level Up Results, RESULTS by Twyla, their staff, contractors, business partners, and property management from liability for injuries, losses, or damages arising from participation in any program, including virtual and in-person sessions.
-
This includes negligence or incidents occurring on premises, virtual platforms, or affiliated third-party facilities.
10. Massachusetts and Legal Compliance

These TOS are governed by the laws of the Commonwealth of Massachusetts unless otherwise required by applicable law.

Any provisions required by law to differ from these terms will override conflicting terms.
11. Amendments and Updates
-
Level Up Results reserves the right to update these TOS at any time.

Clients will be notified of significant changes and continued use of services constitutes acceptance of the updated TOS.
12. Agreement and Acknowledgment
By enrolling in or using our services, you acknowledge that you have read, understood, and agree to these Terms of Service and Client Agreement, including the scope of services, responsibilities, disclaimers, and liability releases.
